1. General Provisions
These Terms and Conditions ("Terms") govern the sale of goods by E-MARC Bearings ("Seller") to the customer ("Buyer"). By placing an order for any products, including but not limited to Heavy Duty Bearings or Automotive Kits, the Buyer agrees to be bound by these Terms.
No variation of these Terms shall be binding unless agreed to in writing by an authorized representative of the Seller.
2. Orders and Acceptance
All orders are subject to acceptance by E-MARC. We reserve the right to cancel or refuse any order for any reason, including stock discrepancies or errors in pricing. For Bulk/Wholesale Orders, a formal Purchase Order (PO) is required.
Backorders: If a specific item (e.g., specialized SKF Explorer units) is out of stock, we will notify the Buyer with an estimated lead time. The Buyer may choose to wait or cancel the backordered portion.
3. Shipping, Risk, and Title
Unless otherwise agreed in writing, all international shipments are EXW (Ex Works) from our logistics centers in the USA, Japan, or Europe.
- Risk of Loss: Risk passes to the Buyer once the goods are handed over to the carrier (DHL, FedEx, UPS, or Freight Forwarder).
- Insurance: Shipping insurance is optional and is the responsibility of the Buyer unless requested and paid for at the time of order.
- Customs Duties: The Buyer is solely responsible for all import duties, taxes, and brokerage fees in the destination country.
4. Returns and Cancellations (RMA)
Returns are accepted within 30 days of delivery, subject to the following conditions:
- RMA Number: Buyer must contact support to obtain a Return Merchandise Authorization (RMA) number before shipping.
- Condition: Items must be unused, in original packaging, and free of grease/oil contamination. Opened master cases for bulk items are non-returnable.
- Restocking Fee: A 15% restocking fee applies to all non-defective returns to cover inspection and repackaging costs.
5. Warranty and Limitation of Liability
E-MARC warrants that all products sold are genuine and free from defects in material and workmanship for a period of 12 months from the date of shipment.
Exclusions: This warranty does not cover failure due to: improper installation, lack of lubrication, misalignment, or operating conditions exceeding the manufacturer's specifications (e.g., load/speed ratings detailed in our Technical Datasheets).
Liability Cap: In no event shall E-MARC be liable for consequential, incidental, or special damages, including machine downtime or lost profits.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in the United States.
